The matter above mentioned was listed before the Hon'ble Court on 24th January, 2024, when the Court was pleased to pass the following order:
"1. Learned Senior counsel appearing for the respondent-State seeks to refer to counter affidavit stated to have been filed in the month of July, 2021, the same is not on record.
2. Learned counsel for the petitioner submits that he has been served with an advanced copy of the counter affidavit. We are informed by the Registry that no such counter affidavit has been filed by the respondent-State.
3. Last opportunity of one week is granted to the learned counsel for the respondent-State (in Civil Appeal No.11352 of 2013) as well as to the learned counsel for respondent No.1-RPSC (in Civil Appeals No.11353- 11354/2013) to file counter affidavit with a copy to the other side.
4. List on 31st January, 2024 high up on the Board. "
It is submitted that Mr. Aniruddha Deshmukh, Advocate has on 29th January, 2024 filed Counter Affidavit on behalf of Respondent No. 1 (Rajasthan Public Service Commission) in both the matters (separately) . Copies of the same are being circulated herewith for kind perusal of the Hon'ble Court.
It is further submitted that Mr. D.K. Devesh Advocate has on 30th January, 2024 e-filed Counter Affidavit on behalf of Respondent No. 2 (State of Rajasthan) in Civil Appeal No. 11352 of 2013. Copy of the same is being circulated herewith for kind perusal of the Hon'ble Court.
