This Hon'ble Court, on 08th December, 2023, was pleased to pass the following order:

" The respondent No.2, who was impleaded as Head of the village 'Kakiho', has passed away on 08.09.2021. The dispute between the parties is over recognition of villages in the State of Nagaland. In such circumstances, the right to sue survives on the successor in office. In this application registered as I. A. No. 177622 of 2023, the present Head Man of the same village is sought to be brought on record. We condone the delay in bringing the application for substitution and set aside the abatement of the proceedings so far as the respondent No.2 is concerned. Let respondent No. 2 be substituted by 'Mr. Atoka K. Achumi', who is the Head Gaonbura cum Chairman of Kakiho village. 

 Necessary alteration of records is to be effected and matter to be listed after six weeks."

It is submitted that pursuant to aforesaid order, cause title has been amended and included in SLP paper books.

It is further submitted that there are 7 respondents in this matter. Ms. Renuka Sahu, Advocate has e-filed Vakalatnama/Appearance on behalf of respondent Nos. 1 & 2 and counter affidavit has already been filed by erstwhile advocate. Copy of the same has been included in SLP paper books.  Ms. K. Enatoli Sema, Advocates have filed Vakalatnama/Appearance on behalf of respondent Nos. 3 to 7 respectively, and have already filed Counter affidavits on behalf of them. The same have been included in SLP paper books. Counsel for the petitioner has not filed Rejoinder affidavit as per Court's order dated 26.09.2016.
