The I.ANO.9666, 9667 and 9668/2018 (Application for Substitution of deceased R.Nos.1, 9 and 11;  Application for Condonation of delay of 572, 265 & 8057 days in filing substitution alongwith setting aside abatement and Application for Exemption from filing O.T. of Annexure A1 to A3) was listed before Hon'ble Judge(In Chamber), on 1st May, 2018, when the Court was pleased to pass the following order:

" Issue notice on the applications for substitution to bring on record the Lrs of deceased respondent Nos. 1, 9 and 11, condonation of delay in filing substitution and setting aside abatement."

Thereafter, the matter was time to time listed before Ld. Registrar Court for completion of service on the proposed legal representative of deceased R.NOs. 1, 9 and 11 and last listed before HOn'ble Judge(In Chamber), on 27th February, 2020, when the Court was pleased to pass the following order:

" Perused Office Report dated 07.02.2020.

Ms. Isha Aggarwal, learned counsel appearing for the petitioners, prays for and is granted two weeks further time as a last chance to take fresh steps to effect service on respondent no.9(i) failing which the special leave petition shall stand dismissed qua respondent no.9(i) without any further reference to the Court.

If steps are taken by learned counsel for the petitioners within the time granted, the Registry to issue notice to respondent no.9(i).

In case if steps are not taken in respect of respondent no.9(i) within the stipulated time granted by this Court, the Registry is directed to process the matter for being listed before the Court forthwith. "

It is submitted that Counsel for the Petitioner has not taken fresh steps in respect of proposed legal representative no.9(i) so far.  However, Ms. Jyoti Mendiratta, Advocate has on 16.3.2020 filed vakalatanama and memo of appearance on behalf of proposed legal representative no.9(i) and also on behalf of proposed legal representative no.9(ii) and 9(iv) -9(vi). 

Latest service position is as follows :

No. of  legal representative of deceased R.No.1 are  4(Four).

Proposed legal representative nos.1(i) to 1(ii)  : Vakalatnama filed by Ms. Jyoti Mendiratta, Advocate

Proposed legal representative nos.1(iii) to 1(iv)  : Service of show cause notice on I.A. is complete as per tracking report but no one has filed           

vakalatnama and memo of appearance on their behalf.

No. of  legal representative of deceased R.No.9 are  7(Seven).

Proposed legal representative nos.9(i) to 9(ii) & 9(iv) to 9(vii) : Vakalatnama filed by Ms. Jyoti Mendiratta, Advocate

Proposed legal representative nos.9(iii)   : Service of show cause notice on I.A. is complete as per tracking report but no one has filed

 vakalatnama and memo of appearance on their behalf.

No. of  legal representative of deceased R.No.11 are 2(Two)

Proposed legal representative nos.11(i) to 11(ii) : are common as R.Nos. 10 and 12 and are represented through Ms. Jyoti Mendiratta, Advocate

Service of show cause notice on IAS. is complete.
