The matter above-mentioned was listed before the Hon'ble Court, on 16th March, 2021, when the Court was pleased to pass the following order:
"Counsel for respondent No.1 in SLP (C) Nos.23091-23092/2017 and 23105-23106/2017 to file vakalatnama and memo of appearance on behalf of the petitioner in Transferred Case No.2 of 2018.
Issue notice in Transferred Cases.
Counsel for the petitioner(s) to take steps for effecting service on the unserved respondents in Transferred Case Nos. 1 and 2 of 2018.
As State of Maharashtra is already represented by Mr. Rahul Chitnis, learned counsel, that notice is waived.
List these matters after two weeks.
Transferred Case Nos. 1 and 2 of 2018 be treated as leading matters and the same will proceed for final disposal on the next date of hearing."
TRANSFERRED CASE (CIVIL) No. 1 OF 2018
There are three respondents in the matter above-mentioned.
It is submitted that Mr.G.S.Makkar and Mr.Sachin Patil, Advocates have filed vakalatnama and memo of appearance on behalf of Respondent Nos. 1 and 3.
It is further submitted that counsel for the petitioner has on 10-4-2021 filed three set of spare copies for issuance of notice to unserved respondent No.2 and there is delay of 20 days in filing spare copy and he has on 13-4-2021 filed application for condonation of delay in filing spare copy. Hence fresh notice could not be issued to unserved respondent so far.
Service is not complete on Respondent No.2
TRANSFERRED CASE (CIVIL) No. 2 OF 2018
There are five respondents in the matter above-mentioned.
It is submitted that Mr.G.S.Makkar and Mr.Sachin Patil, Advocates have filed vakalatnama and memo of appearance on behalf of Respondent Nos. 2 and 3 and has also filed counter affidavit on behalf of Respondent NO.2 (Ministry of Environment Forest).
It is further submitted that counsel for the petitioner has on 23-3-2021 filed proof of service of Copy of Transferred Case through email on M/s.Karanjawala and Co., for Respondent Nos.4 and 5, as in SLP(C)No.23091-23092 of 2017 (connected matter) M/s.Karanjawala and Co., Advocates has filed vakalatnama and memo of appearance on behalf of (Respondent Nos.4 and 5) intervenor in I.A.No.95876 of 2017 (application for intervention) but no one has entered appearance on behalf of Respondent Nos. 4 and 5. in instant matter. Hence Service is complete may be treated as complete.
It is also submitted that counsel for the petitioner has also served copy of Transferred Case on Mr.G.S. Makkar for Respondent No.1 (Union of India) but no one has entered appearance on their behalf so far.
SLP (CIVIL) NO. 23105-23106 OF 2017
It is submitted that SLP (C) No. 23105-23106 of 2017 is a fresh matter and connected with SLP(C)No.23091-23092 of 2017
Service of notice is complete.
The Transferred Cases above-mentioned are listed before the Ld.Registrar Court with this office report.
