The matter above mentioned was listed before the Hon'ble Court, on 20th November, 2019, when the following order was passed:

" None appeared for respondent No.4 when called. The record shows that vakalatnama on behalf of the said respondent has been filed on 18.2.2019, however, counter affidavit has not been filed till today. There is neither written application for extension of time to file pleadings in terms of Order V Rule 1(22), Supreme Court Rules, 2013 nor is there oral request to that effect. It appears that respondent No.4 is not interested in filing counter affidavit and, therefore, opportunity to file counter affidavit stands declined. 

Four weeks' time is granted to respondent No.5 for filing counter affidavit.

Service is complete on respondent Nos.1 to 3. Ld. Advocate, Mr. Seshatalpa Sai Bandaru, appearing on behalf of Mr.Nishant R. Katneshwarkar, Advocate-on-record appears for respondent Nos.1 to 3. He seeks time to file vakalatnama and counter affidavit. Be filed within four weeks.

List again on 30.1.2020. "

It is submitted that neither counter affidavit nor written application for extension of time to file pleadings has been filed on behalf of Respondent No. 5 in terms of Order V Rule 1(22), Supreme Court Rules, 2013 which read as under:-

                       "Application for extension of time for filing pleadings, provided that the Registrar shall not grant more than one extension for the purpose exceeding four weeks."

It is further submitted that Ld. Advocate who appeared before Ld. Registrar Court on 20.11.2019 has not filed vakalatnama and counter affidavit on behalf of Respondent No. 1 to 3 so far.

Service of notice is complete.

The matter above-mentioned is listed before the Court of Ld. Registrar with this Office Report.
