This Hon'ble Court, on 22nd February, 2021, was pleased to pass the following order:

" Issue notice on the application for condonation of delay as well as on the Special Leave Petition, returnable within four weeks. 

 Dasti, in addition, is permitted. "

Accordingly, show cause notice was issued to all the respondents in above-mentioned SLPs through registered A.D. post on 01st March, 2021 as well as Dasti Notice. Service position of matters is under: 

SLP (C) No.24631, 24491 & 24253 of 2020

It is submitted that there are total two respondents in these SLPs and as per track report of India Post, service of notice is complete on both the respondents on 3rd and 4th March, 2021, but no one has entered appearnace on their behalf so far.  However, it may be mentioned that Respondent No.2 (DDA) is common in all the matters. Counsel for the Petitioner has not filed Affidavit of Dasti Service with proof.

It is further submitted that both the respondents in these SLPs duly served with notice on 3rd and 4th March, 2021 have neither filed Counter Affidavit in terms of Order XXI Rule 14(1) of the Supreme Court Rules, 2013 nor filed application for extension of time in terms of Order V Rule 1(22) of the Supreme Court Rules, 2013 so far. 

Service is complete. 

SLP (C) No.24367 of 2020

It is submitted that there are total three respondents in this SLP and as per track report of India Post, notice has been delivered to all the three respondents on 3rd March, 2021, but no one has entered appearnace on their behalf so far. Counsel for the Petitioner has not filed Affidavit of Dasti Service with proof.

It is further submitted that all the three respondents in this SLP duly served with notice on 3rd March, 2021 have neither filed Counter Affidavit in terms of Order XXI Rule 14(1) of the Supreme Court Rules, 2013 nor filed application for extension of time in terms of Order V Rule 1(22) of the Supreme Court Rules, 2013 so far.

Service is complete. 

SLP (C) No.24368 of 2020

It is submitted that there are total five respondents in this SLP and as per track report of India Post, service of notice is awaited in respect of Respondent No.1 and notice has been delivered to  Respondent Nos.2 to 5 on 03rd and 6th March, 2021, but no one has entered appearnace on their behalf so far. Counsel for the Petitioner has not filed Affidavit of Dasti Service with proof.

It is further submitted that both Respondent Nos.2 to 5 in this SLP duly served with notice on 3rd and 6th March, 2021 have neither filed Counter Affidavit in terms of Order XXI Rule 14(1) of the Supreme Court Rules, 2013 nor filed application for extension of time in terms of Order V Rule 1(22) of the Supreme Court Rules, 2013 so far.

Service is awaited in respect of Respondent No.1.

Order XXI Rule 14(1) of Supreme Court Rules, 2013 is read as under:

"Respondent to whom a notice in a Special Leave Petition is issued or who had filed a caveat shall be entitled to oppose the grant of leave or interim orders, without filing any written objections. He shall also be at Iibeny to file his objections within 30 days from the date of receipt of notice or not later than 2 weeks before the date appointed for hearing, whichever be earlier, but shall do so only by setting out the grounds in opposition to the questions of law or grounds set out in the SLP and may produce such pleadings and documents filed before the Court/Tribunal against whose order the SLP is filed and shall also set out the grounds for not granting interim order or for vacating interim order if already granted."

Order V Rule 1(22) of Supreme Court Rules, 2013 is read as under:

"Application for extension of time for filing pleadings, provided that the Registrar shall not grant more than one extension for the purpose exceeding four weeks."

The Petitions above-mentioned are listed before the Court of Ld. Registrar with this Office Report.
