This Hon'ble Court, on 26th September, 2022, was pleased to pass the following order:
" 1 Counsel appearing on behalf of the petitioner states that the name of the petitioner is reflected in the voter lists of 1966 and 1970 (Annexure P-1 & P- 2).
2 Issue notice on the application for condonation of delay in filing the petition and on the Special Leave Petition, returnable in three months.
3 Ms Aishwarya Bhati, Additional Solicitor General and Mr Shuvodeep Roy, counsel appear on behalf of the Union of India and the State of Assam respectively and waive service.
4 A copy of the petition be served on the counsel for the Union of India and counsel for the State of Assam.
5 Counter affidavit be filed within a period of six weeks.
6 No coercive steps shall be taken against the petitioner till the next date of listing. "
It is submitted that pursuant to order quoted above show cause notice was issued to all the six respondents on 26.10.2022 by regd. A.D. as well as Standing counsel for the Union of India and the State of Assam respectively. Mr. Shuvodeep Roy, Advocate has filed vakalatnama/memo of appearance on behalf of respondent Nos. 3 to 6 but has not filed counter-affidavit on their behalf so far. As per track report of India Post service is complete in respect of respondent Nos. 1 and 2, but no one has entered apperance on their behalf so far. Pursuant to order above counsel for the petitioner has on 21.11.2022, filed proof of service of copy of petition to Standing counsels for Union of India and State of Assam.
It is further submitted that Mr. Arvind Kumar Sharma, Advocate and Mr. Amit Sharma, Advocate have appeared on 13.12.2022 before Ld. Registrar Court on behalf of respondent Nos. 1 and 2 respectively but they have not filed vakalatnama/memo of appearance on behalf of their respective respondents.
It is further submitted that counsel for the petitioner has on 17.10.2022, has filed an application for correction of this Court's Order dated 26.09.2022, (regd. as I.A. No. 157517/2022) and copy of the same has been placed with SLP paper books.
Service is complete.
The Petition alongwith applications above-mentioned are listed before the Hon'ble Court with this Office Report.
