This Hon'ble Court, on 10th February, 2023, was pleased to pass the following order:

" Application for condonation of delay in filing the substitution application as well as application for setting aside the abatement are allowed.

 Issue notice on the application for substitution. "

It is submitted that pursuant to aforesaid order Show Cause Notice was issued to proposed Lrs Nos. 4 (B) to 4 (E) and 4F1 to 4F (III) of deceased respondent no.4 on 27.2.2023 through registered A.D post. As per India Post Track Report notice have been delivered to Proposed Lrs of deceased respondent no.4 but no one has entered appearance on their behalf so far. 4(a) wife of deceased respondent no. 4 has died.

It is further submitted that Counsel for the respondent nos. 1 to 3 and 5 have already filed reply affidavit on their behalf. 

Service is complete on respondent nos. 1 to 3 & 5 and all the Lrs. of deceased respondent No.4.

Application in the The Petition above-mentioned is listed before the Hon'ble Judge in Chamber with this Office Report.
