The matters above mentioned were listed before the  Hon'ble Court, on 18th September, 2023, when the Court was pleased to pass the following order :

"In view of letter circulated by learned counsel for the petitioner seeking an adjournment, list after four weeks."

It is submitted that, pursuant to letter as referred to in the order quoted above, counsel for the petitioner has not filed any documents/compilation of documents so far.

It is further, submitted that Mr. Ujjal Banerjee, Advocate has on 19.4.2023 filed an application for intervention on behalf of the applicant namely (Majestic Auto Limited) in SLP(C) No. 20041/2021 (registered as I.A.No. 80754/2023) and copy of the same has been placed with SLP Paper Books. Mr. S.S.Shroff, Advocate has on 15.3.2023 e-filed Vakalatnama/appearance on behalf of proposed Intervenor (committee of creditors of Sharan Hospitality pvt. ltd in IA. No. 6926/2022) after taking NOC from erstwhile advocate. 

It is further submitted that, Mr. Arnav Narain, Advocate has on 17.01.2022 filed Vakalatnama/Appearance along with application for permission to intervention (registered as IA No. 6926/2022) on behalf of the applicant in SLP (C) No. 20041/2021. Copy of the same has been included in SLP Paper Books.

It is lastly submitted that Counsel appearing for respondent no.1 in both the matters have filed counter affidavits on their behalf and counsel for the petitioner has filed Rejoinder Affidavits thereto. Copies of Counter/Rejoinder Affidavits have been included in SLP Paper Books. No one has entered appearance on behalf of common respondent nos. 2 to 15 , 20 and 21 in both the matters though served. Unserved cover have been received back in respect of common respondent nos. 16 to 19 in both the matters.

The matters above mentioned were listed before the  Hon'ble Court, on 20th September, 2024, when the Court was pleased to inter-alia pass the following order :

"SLP (C) No(s). 20028/2021 & SLP(C) No. 20041/2021

List on 17th December, 2024. 

Interim order granted earlier to continue till further orders.

Service is not complete on common respondent nos. 16 to 19 in both the matters.

The Petitions along with applications above-mentioned are listed before the Hon'ble Court with this Office Report.
