This Ld. Registrar Court, on 27.04.2023, was pleased to pass the following order:

" Respondent nos.1 to 3 have already filed counter affidavit.

  Despite due service on respondent no.4, there is no appearance. 

  Ld. counsel for petitioner has failed to take fresh steps, for effecting service upon respondent nos.5 and 6. However, as requested, two weeks time, is granted as a last chance to take fresh steps in respect of said respondents. 

 If needful is done, notice be issued to the respondents and list again on 19.07.2023.

 Failing which, process the matter for listing before the Hon’ble Judge-in-Chambers, for further directions."

This Hon'ble Court's (In-Chamber), on 02nd November, 2023, was pleased to pass the following order:

" Let steps be taken for effecting service on respondent Nos. 5 and 6 within two weeks from today failing which the Special Leave Petition shall stand automatically dismissed for non-prosecution qua the said unserved respondents without further reference to the Court. "

It is submitted that respondent nos. 1 to 3 have already filed counter affidavit.

It is further submitted that Mr. Deepkaran Dalal, Advocate has filed vakalatnama & memo of appearance on behalf of respondent no. 4 but has not filed counter affidavit so far.

It is further submitted that counsel for the petitioner has not taken steps to effect service on respondent nos. 5 and 6 within the time granted by the Hon'ble Court's (in-Chamber) order dated 02.11.2023, hence SLP qua respondent nos. 5 and 6 are dismissed for non-prosecution.

Service is complete on respondent nos. 1 to 4 & SLP dismissed qua respondent nos. 5 and 6 vide Hon'ble Court's (in-Chamber) order dated 02.11.2023.

The Petition above-mentioned is listed before the Ld. Registrar with this Office Report.
