The matter above mentioned was listed before the Hon'ble Court, on 17th May, 2022, when the Court was pleased to pass the following order:
" The learned counsel for the petitioners relies upon a Judgment of this Court in Laljibhai Kadvabhai Savaliya & Ors. Vs. State of Gujarat & Ors. reported in (2016) 9 SCC 791.
Issue notice on the Special Leave Petition as well as on the prayer for interim relief.
Notice be also served on the standing counsel for the State.
Dasti, in addition, is permitted.
List the matter in the week commencing 11.07.2022. "
Accordingly, notice was issued to all the 22 respondents by registered A.D. Post on 25th May, 2022. Mr. Amrish Kumar, Advocate, Ms. Deepanwita Priyanka, Advocate and Ms. Priya Puri, Advocate have filed Vakalatnama and Memo of Appearance on behalf of Respondent Nos. 2, 3 and 4 respectively. As per track report of India Postal Service notice was delivered on Respondent Nos. 1, 5 to 9, 11 to 22 but not one has entered appearance on their behalf so far. As per track report of India Postal Service notice was not delivered on Respondent No. 10.
It is submitted that counsel for the petitioner has on 06th July, 2022 e-filed a proof of serving notice through E-mail on Ms. Deepanwita Priyanka Standing Counsel for the State and Central Agency. Counsel for the Petitioner has not filed proof of dasti service on Respondent No. 10.
Service of notice is not complete on Respondent No. 10.
The Petition above-mentioned is listed before the Hon'ble Court with this Office Report.
