The matter above mentioned was listed before the Ld. Registrar's Court on 10th February, 2023, when the following order was passed:

" Despite due service of notice on respondent Nos. 3 to 11, 14 and 17, there is no appearance. 

  Ld. Counsel for respondent Nos. 1, 2, 15 and 16 have failed to file the counter affidavit within the period stipulated under the rules. 

  Ld. Counsel for petitioners has neither filed fresh particulars and taken steps nor filed application for substituted service in respect of respondent Nos. 12 and 13 despite Order dated 5.1.2023. 

   Hence, the matter be processed for listing before the Hon'ble Judge in Chambers, for further directions."

Thereafter, office report for direction with application for publication was listed before the Hon'ble Court(In Chambers), on 03rd May, 2023, when the Court was pleased to pass the following order:

" I.A. No. 91171 of 2022 

   Application seeking substituted service is allowed. 

 Learned counsel for the applicant is permitted to take out notice to the respondent Nos. 12 and 13 through publication in newspaper Ajkalin Bengali and Statesmen in English. 

   Delay in filing the counter affidavit is condoned, same is taken on record."

It is further submitted that Mr. Roshan Santhalia, Advocate has filed Vakalatnama on behalf of respondent nos. 1 and 2 after taking NOC from the earlier Counsel and has also filed two separate Counter Affidavit on their behalf along with application for condonation of delay which has been condoned vide Chamber Judge order dated 03.05.2023. 

Service of notice is complete on all the respondents except respondent nos. 12 and 13.

The Petition above-mentioned is listed before the Court of Ld. Registrar with this Office Report.
