The matter above-mentioned was listed before the Hon'ble Court on 27th September, 2022, when the Court was pleased to pass the following order:

" This petition has been filed by the petitioner-wife seeking transfer of Civil Proceedings No. 768 of 2022 "Abinash Mohapatra vs. Shiny Panigrahi" filed by respondent-husband under Section 9 of the Hindu Marriage Act, 1955 for the restitution of conjugal rights pending before the Family Court, Bhubaneshwar, Odisha to the Family Court at Panvel, District Raigad, Maharashtra. 

 In the interest of justice, issue notice to the respondent, returnable in six weeks. 

Steps must be taken by the petitioner within ten days. 

In the meanwhile and until further orders, further proceedings in Civil Proceedings No. 768 of 2022 titled as "Abinash Mohapatra vs. Shiny Panigrahi"pending before the Family Court, Bhubaneshwar, Odisha shall remain stayed. "

Accordingly, Certified copy of Hon'ble Court's order to concerned Trial Court and notice to sole respondent  were issued through Registered A.D. Post on 03.10.2022 and 04.10.2022.

It is submitted that as per tracking report, notice has been delivered to sole respondent on 10.10.2022 and Mr.Ashok Panigrahi, Advocate has on 16-11-2022 filed Vakalatnama and memo of appearance on behalf of sole respondent but has not filed counter affidavit so far.

Service of notice is complete.

The Petition above-mentioned is listed before the Hon'ble Court with this Office Report.
