RE-VISED OFFICE REPORT

This Hon'ble Court, on 11th July, 2023, was pleased to pass interalia the following order:

" .....xxxxxx..

8 The maintenance of law and order and preservation of the security of the State are essentially matters which fall in the domain of the executive. The deployment of the army or paramilitary forces must be left to the State administration and the Union of India to oversee. The Union of India and the State of Manipur should make sufficient arrangements to ensure the protection of the lives and properties of all citizens and residents of the State of Manipur.

9 An updated Action Taken Report shall be filed within a period of two weeks.

10 List the Petitions on 28 July 2023."

The aforesaid matters were mentioned before the Hon'ble court on 20th, July, 2023, when the Court was pleased to pass the following order : 

"1 Taken on Board. 

2 We have taken up the proceedings in the above Petitions by requesting the learned Attorney General and the Solicitor General to be present at 10.30 am. 

3 The Court is deeply disturbed by the visuals which have appeared in the media since yesterday depicting the perpetration of sexual assault and violence on women in Manipur. What is portrayed in the media would indicate gross constitutional violations and infractions of human rights. Using women as instruments for perpetrating violence is simply unacceptable in a constitutional democracy.

4 This Court must be apprised of the steps which have been and shall be taken by the government to (i) hold the perpetrators accountable; and (ii) ensure that such incidents are not repeated. 

5 The Union Government and the State Government are directed to take immediate steps - remedial, rehabilitative and preventive and to apprise the Court of the action which has been taken before the next date of listing on affidavit. 

6 The affidavits shall be filed by the Union Home Secretary and the Chief Secretary for the State of Manipur. 

7 List the Petitions on 28 July 2023."

It is submitted that, pursuant to orders quoted above counsel for the parties have not filed any documents so far.

It is also submitted that, Mr. Siddhesh Shrish Kotwal, Advocate has on 27.07.2023 filed Vakalatnama/Appearance on behalf of 'S.S. Human Rights Foundation' along with application for intervention/impleadment to implead 'S.S.Human Rights Foundation', Registered Office at Billagram, Purba Bardhaman, West Bengal as Respondent without filing proof of Court Fee and service on other side (IA D. No. 144564/2023). However, copy of the same is being circulated herewith. 

It is further submitted that, Dr. N. Visakamurthy, Advocate has on 21.07.2023 filed Memo of appearance on behalf of Respondent No. 12.

Lastly, the matters above mentioned were listed before this Hon'ble Court, on 31st July, 2023, was pleased to pass interalia the following order:

"1. List the Petitions tomorrow (1 August 2023) at 2.00 pm."

It is lastly submitted that Mr. Siddhesh S. Kotwal, Advocate has on 31.07.2023 e-filed an application for intervention (I.A. D. no. 147906/2023) but praying for impleadment along with vakalatnama and he has also e-filed an application for direction (I.A. Diary no. 147907/2023) and copy of the same are being circulated herewith.

The Petitions along with applications above-mentioned is listed before the Hon'ble Court with this Office Report.
