This Hon'ble Court, on 27th September, 2023, was pleased to pass the following order:

" Issue notice on the application for condonation of delay as well as on the present special leave petition, returnable in the month of January 2024. 

Notice will be served by all modes, including dasti. 

 Though the petitioner - Jagdish Kumar Parulkar has notfiled any application for interim relief, noticing the fact that the erstwhile management had executed documents during the pendency of the insolvency proceedings, and pursuant to that third party interest has been created, we direct that respondent no. 1- M/s Indore Steel and Alloys Private Limited will not create any third party interest till the next date of hearing. "

Pursuant to the above quoted order, it is submitted that show cause notice dated 05.10.2023 returnable for 05.01.2024 to all the 5 respondents through usual mode and dasti as well, however, Ld. Counsel for the Petitioner has not filed proof of dasti service after serving all the respondents so far. As per Indian post, notice has been delivered on respondent no. 1 only and Mr. Harsh Parashar, Advocate has on 06.10.2023 and 31.10.2023 filed Vakalatnama/Memo of Appearance and counter affidavit on behalf of respondent no. 1 only and copy of the same has already been placed with paperbooks for the kind perusal of the Hon'ble Court.

It is further submitted that Ld. Counsel for the Petitioner has filed rejoinder affidavit without the leave of the Court and copy of the same is being circulated herewith for the kind perusal of the Hon'ble Court.

Service is not complete on respoondent nos. 2 to 5.

The Petition along with applications above-mentioned is listed before the Hon'ble Court with this Office Report.
