This Ld. Registrar's  Court, on 16th January, 2024, was pleased to pass the following order:

" Ld. Counsel for petitioner submits that petitioner No.1 is expired and yesterday he has filed application for substitution to bring on record his Lrs. Registry to verify the same and report.

 Respondent Nos.1 and 5 have already filed the counter affidavit. 

 Despite service of notice on respondent Nos.2 and 4, there is no appearance on their behalf. 

 Service is not complete in respect of respondent No.3. However, Mr. Shantwanu Singh, Ld. Advocate-on-Record has appeared on behalf of respondent No.2 and Mr. T. Mahipal, Ld. Advocate-on-Record has appeared on behalf of Respondent No.3.

They seek and are granted four weeks time to file vakalatnama and counter affidavit.                Learned counsel for petitioners is directed to provide the copies of the petition papers to the learned counsel for the respondent No.3 within a week and file necessary proof thereof. 

 Ld. Counsel appearing on behalf of Respondent No.4 submits that he has already filed the vakalatnama and counter affidavit on behalf of Respondent Nos.4.

 Registry to verify the same and report. List again on 1.3.2024. "

It is submitted that counsel for the petitioner has filed application for substitution to bring on record his Lrs. but the same is defective as vakalatnama of proposed legal heirs has not been filed with application. 

Counsel appeared for respondent no 2 and 3 have not filed vakalatnama and counter affidavit so far. 

Counsel for the appellant has also not filed proof of service of copy of the petitioner on the ld. counsel for respondent no. 3.

It is submitted that Advocate Shakti Kanta Pattaniak,  has filed vakalatnama and memo of appearance on behalf of respondent no. 1.

It is further submitted that caveator/counsel for the respondent no. 4 Advocate Shakti Kanta Pattaniak, has on 11.01.2024 filed counter affidavit but the same is again filed on behalf of respondent no. 1 instead of respondent no. 4. and no counter affidavit on behalf of respondent no. 4 has been filed so far. 

It is also submitted that counsel for the respondent no . 5 has already filed counter affidavit.

Service on all the five  respondent is complete. 

The Office Report in the matter is listed before the Ld. Registrar's Court with this office report.
