This Hon'ble Court, on 10.11.2023, was pleased to pass the following order:
"The argument advanced on behalf of the appellant by the learned senior counsel, Mr. Siddharth Bhatnagar, is to the effect that the objections to the acceptance of written statement filed by Defendant No.1 and Defendant No.2 was already pending before the Commercial Court at the time when the written statementfiled by Defendant No.3 was allowed to be taken beyond the prescribed limitation.
Issue notice, returnable within six weeks.
In the meantime, further proceedings in C.S. No.63 of 2022 pending before the Commercial Court, District Faridabad, Haryana, shall remain stayed."
It is submitted that show cause notice has been issued to all the three respondents through registered AD Post. As per postal tracking report notice has been returned back with remarks "Addressee left without instructions" in respect of respondent no. 1, "Insufficient Address" in respect of respondent no. 2 and "No such person in the address" in respect of respondent no. 3.
Service of show cause notice is incomplete on all the three respondents.
