This Hon'ble Court, on 03rd November, 2023, was pleased to pass the following order:

"Application for exemption from filing a certified copy of the impugned judgment is allowed.

Issue notice returnable on 12th January, 2024.

We direct that no coercive action shall be taken against the petitioner for non-payment of amount mentioned in the paragraph 64 of the impugned judgment, subject to the condition of petitioner depositing Rs.36,95,736/- (Rupees thirty six lakhs ninety five thousand seven hundred thirty six) with the High Court within a period of six weeks from today.

The learned senior counsel appearing for the petitioner states that another event of the petitioner is scheduled to be held in December, 2023.

We direct that the application made by the petitioner for grant of permission to hold the event shall be considered on merits, notwithstanding pendency of this petition.

However, if permission is granted, the petitioner will pay the amount as demanded by the Comunidade by depositing the same with the Administrator of the Comunidade.

We make it clear that as the issue of power of the Government to reduce the amount demanded by the Communidade is subject matter of this petition, the State Government will not reduce the said amount.

Needless to add that the deposit of the amount by the petitioner will be subject to the final outcome of this petition."

It is submitted that pursuant to above quoted order, show cause notice returnable on 12.1.2024 was issued to all the eight respondents through registered A.D. post on 7.12.2023. As per tracking report, notice has been delivered to all the respondents but no one has entered appearance on their behalf so far.

It is further submitted that Counsel for the petitioner has on 11.1.2024 filed an application seeking permission to bring on record additional documents with annexures P16 to P19. However, some of the pages are having dark photo impression and dim impression. As the matter is on board, copy of the application as I.A. Dy. No. 8849 of 2024 is being circulated herewith for kind perusal of the Hon'ble Court).
