This Hon'ble Court, on 16th January, 2024, was pleased to pass the following order:1.
"1. Ms Archana Pathak Dave, counsel appearing on behalf of the petitioner, submits that an unreasoned interim order has been passed by the High Court permitting the respondents to participate in the stray round of counselling though two inspections had revealed serious deficiencies in the infrastructure. Counsel has relied on an order passed by this Court on 8 December 2023 in SLP(C) Nos 26719-26720 of 2023.
2 Issue notice, returnable on 5 February 2024.
3. Till the next date of listng, there shall be a stay of the operation of the impugned order of the High Court of Punjab and Haryana dated 28 November 2023 in CWP No. 26668 of 2023."
Accordingly show cause notice was issued to all the four respondents in the matter through Regd. A. D. Post.
It is submitted that Mr. G. S. Makker, Advocate has filed vakalatnama on behalf of respondent no. 2 but has not filed counter affidavit so far.
It is further submitted that as per postal tracking report, notice issued in respect of respondent no. 1 has been returned with remarks "No such person in the address".
It is again submitted that no one has entered appearance on behalf of respondent nos. 3 & 4 so far though served with notice as per postal tracking report.
It is lastly submitted that Ms. Archana Pathak Dave, former counsel for the petitioner has been designated as Senior Advocate and accordingly a notice for alternative arrangement has been issued to the sole petitioner in the matter. The postal tracking report for same is awaited and no one has entered appearance on behalf of the petitioner so far.
Service of show cause notice is complete on respondent nos. 2-4 and not complete on respondent no. 1.
Service of alternative arrangement notice to the petitioner is awaited.
The instant matter was lastly listed before this Hon'ble Court on 05.02.2024, when the Court was pleased to pass the following order:
"1. List the Special Leave Petition on 26 February 2024."
