1. This Hon'ble Court, on 27-02-2024 (notice issue date), has been pleased to pass the following order:

" 1. It is submitted by the learned Senior counsel“ Mr. Siddharth Luthra that the petitioner Nos.1 to 3 were the Government appointed officials of the Bank and not removable from the Office without the sanction of the Government concerned, however, the necessary sanction under Section 197 of the Code of Criminal Procedure, 1973 was not taken before filing the charge-sheet. According to the learned Senior counsel, though the said contention was specifically raised before the High Court, the same has not been considered.

2. Issue notice, returnable after four weeks. 

3. Dasti service, in addition, is granted. 

4. Liberty is also granted to serve the Standing counsel for the State of Tamil Nadu. "

This matter was lastly listed on 07-01-2025 and the Hon'ble Court was pleased to pass the following order:

" 1. The learned senior counsel, Mr. Luthra drawing the attention of the Court to the provisions contained in Section 8 of the Central Vigilance Commission Act, submits that the complaint in the instant case having been filed at the instance of C.V.C. and the C.B.I. having been directed to investigate the matter and submit the report, it is the C.V.C., which can decide the filing of charge sheet or closure report before the Special Court, and the C.B.I. could not directly submit the charge sheet before the Special Court.

2. In view of the above submission, the learned A.S.G., Ms. Bhati appearing for the respondents seeks time to file the counter on behalf of the C.V.C. to clarify the position of law in this regard.
