This Hon'ble Court, on 20th September, 2024, was pleased to pass the following order:
" 1 Issue notice, returnable in two weeks.
2 Mr Devadatt Kamat, senior counsel appearing on behalf of the petitioner stated that the petitioner has filed a written note on the impleadment of the petitioners as parties to the arbitral proceedings even though they are not parties to the arbitration agreement.
3 Ms Aakanksha Kaul, counsel appearing on behalf of the first respondent states that likewise she would file a short note of submissions not exceeding three pages by the next date of listing.
4 List the Special Leave Petition on 4 October 2024."
It is submitted that show cause notice was issued to Respondent no. 1 through Mr. S.S. Rebello, Advocate and to Respondent nos. 2 and 3 by Registered A.D. Post on 1.10.2024. Mr. S.S. Shroff, Advocate and Mr. Sanyat Lodha, Advocate have on 19.10.2024 and 3.10.2024 filed vakalatnama/ appearance for Respondent nos. 2 and 3 respectively but counter affidavit has not been filed on behalf of respondent nos. 1 to 3 so far.
It is further submitted that counsel for the Respondent no. 1 has on 5.10.2024 filed note of submission without serving on the other side however the same is being circulated herewith. He has also on 17.10.2024 filed compilation of documents (Volume I,II and III) and the same is being circulated herewith. Counsel for the Respondent no. 2 has on 23.10.2024 filed brief note of submissions without serving on Mr. S.S. Rebello, Advocate and Ms. Anindita Mitra, Advocate however the same is being circulated herewith.
Service is complete.
The Petition alongwith applications above-mentioned is listed before the Hon'ble Court with this Office Report.
