1. This Hon'ble Court, on 29-11-2024 (notice issue date), has been pleased to pass the following order:

" We have perused the affidavit filed by the petitioner explaining the credentials of the petitioner. Issue notice, returnable on 27th January, 2025. Advocate-on-Record appearing for Respondent no.7 takes formal notice. "

This matter was lastly listed on 17.12.2025 and the Hon'ble Court was  pleased to pass the following order:

"1. At the outset, Mr. S.V. Raju, learned Additional Solicitor General of India, points out that an additional affidavit has been filed by the CBI. However, no such affidavit is found. Instead, a xerox copy of the affidavit, purportedly filed by Mr. Anil Kumar Yadav, Superintendent of Police, CBI on 16.12.2025, has been handed over in Court. 

2. We have perused the averments made in the said affidavit. It is averred that the CBI has decided to collect the relevant documents from the Ministry of Corporate Affairs, SEBI, and the ED so that the issue regarding registration of FIR can be considered. It is further averred that the complete records are not available with the CBI, and that the other agencies were expected to share the same in due course of time. Owing to this, the decision to form an SIT of senior officers of CBI, ED, SFIO, and SEBI could not be taken and the same was deferred. 

3. Further, on 02.12.2025 a meeting was convened by the Director, CBI, which was attended by the Director, ED as well as representatives from SEBI and SFIO. The affidavit points out that the ED has also submitted a fresh complaint to CBI on 15.12.2025, which is still being examined vis-à-vis the allegations levelled in the FIR registered by the Delhi Police. 

4. As of now, we do not want to comment as to what the Agency was doing from 02.12.2025 till the affidavit was filed on 16.12.2025. However, taking into consideration the averments made in the affidavit that various documents are being received/have been received from various agencies, including a fresh complaint from the ED on 15.12.2025, we direct the Director, CBI to take a final call within one week and submit a fresh compliance affidavit on the date fixed. 

5. Another affidavit is said to have been filed by the Dy. Commissioner of Delhi Police, P.S. Economic Offences Wing, but that is also not on record. The Registry is directed to tag the same with the paperbook. A copy thereof be supplied to the petitioner in-person.

The application is disposed of with liberty to respondent No.8 to submit his representation to such authority as he may deem appropriate.

 I.A. No.314514/2025 

1. The Officers of the EOW are present in the Court. 

2. This application has been moved by Mr. Farhat Naeem, an advocate, who wishes to assist this Court with respect to various substantial questions of law which, according to him, have risen in these proceedings. It seems from the nature of the issues raised in the instant application that the same may not directly and substantially arise for consideration in these proceedings. 

3. Consequently, we do not deem it necessary to allow the applicant to intervene in these proceedings. However, the applicant, if so advised, may initiate independent and separate proceedings for raising the issues suggested in the instant application. 

4. With liberty aforementioned, the application stands disposed of. 

5. List the main matter on 21.01.2026. "

It is submitted that pursuant to above mentioned order dated 17.12.2025,  Commissioner of police, Delhi has on 18.12.2025 filed an affidavit and copy of the same is circulated herewith.
